SETTLEMENT

The national settlement, announced in December, requires Ocwen to pay $125 million to borrowers whose homes were foreclosed from Jan. 1, 2009, to Dec. 31, 2012, and commit to $2 billion in first-lien principal-reduction loan modifications through 2016.

California’s share of the settlement with the publicly traded corporation headquartered in Atlanta and two companies it purchased — Litton Loan Servicing and Homeward Residential Holdings — is $268 million, including some $23 million in cash payments.

“My modification was signed by a judge in Riverside,’’ he said, yet Ocwen has been demanding the original payment since it took over loan servicing of the Chase loan in January 2013.

“My attorney and I have sent the whole, 40-page modification agreement over more than once,’’ Anthony said.

Yet he’s still getting harassed with bills demanding the original unmodified amount, a discrepancy in payments that amounts to about $19,000 by now, Anthony said.

Relieved to learn of the settlement, Anthony said he called the Ocwen line three times to speak with a “real person” about his situation. He said he gets nowhere.

“It’s ridiculous,’’ Jean Culligan, an original Mission Mortgage Hills mortgagee on a Corona home who made her monthly payments for years at a Chino Hills bank. “They tell you your call is important, but then you all you get is click, click, click.”

After Culligan’s loan was turned over to Ocwen for debt-servicing, Culligan said she began to rely on the Internet to make sure her mortgage posted on time – paying a $10 to $12 service fee to do so.

“If you’re paying the mortgage, why are they loading on fees?” she asked.

Even then, Culligan said, she’s had her Internet payments post several days after the date on her the giving keys inc stub. Ocwen could not be reached by phone. An e-mail request for comment to the company Tuesday, March 25, generated a reply that Ocwen would respond soon. As of Wednesday, March 26, it had not done so.

Ocwen, which opened in the late-1980s to service problem loans during the Texas real estate bust, acquired Litton Loan Servicing from Goldman Sachs in 2011, Homeward in 2012 and OneWest and Greenpoint in 2013.

A recent financial report by the publicly traded company noted that Ocwen completed 29,979 modifications and more than 5,500 short sales and deeds-in-lieu of foreclosure in the fourth quarter of 2013. Working on the premise that Ocwen has previously reported that its principal mortgage reductions have averaged $75,000, Wyatt said the company would need only to modify 3,600 loans in its portfolio to meet the $268 million threshold set for California.

“That’s not what I would call widespread help for homeowners,’’ Wyatt said.

HOSPICE HOME

Anthony, 69, said that’s not going to stop him from continuing to dial the telephone.

The former construction worker was forced to quit his job five years ago to care for his wife, Alice, when the once vibrant Ralston Purina sales executive was diagnosed with dementia.

“We’ve been battling these people for over a year now,” he said. “I owe it to Alice.”

With Alice now in hospice care, Anthony said the $220,000 home that’s worth less than the mortgage – and landed a judge-decreed modification with Chase – has become a symbol pitting the couple in a fight to the death.

“I get no monthly statements, period,’’ he said. “The only thing they send me is the original bill for $1,577 in change, and I refuse to send them that amount.

Anthony said he and his attorney twice sent out the 40-page modification document to prove the right to make a lower payment.

“It’s unbelievable how uncaring they are. I’ve got a wife laying there in bed. I have no income coming in other than Social Security and I’m pulling my hair out because I’m getting harassed by these guys,’’ Anthony said. “It would be really nice if I could relax about the house.”

  • Imposed force-placed insurance when the servicers knew or should have known borrowers had adequate coverage.

CRITERIA TO QUALIFY AS A FORECLOSURE VICTIM

A settlement administrator will mail notice letters and claim forms to borrowers who lost their home due to foreclosure between Jan. 1, 2009, and Dec. 31, 2012, whose loans were serviced by Ocwen, homeward or Litton and meet other criteria.

Borrowers who choose to receive payments will not have to release any claims, and can seek additional relief in the courts. You may be eligible if:

  • Your home was foreclosed on between Jan. 1, 2009 and Dec. 31, 2012.
  • At the time of foreclosure, your loan was serviced by Ocwen, Homeward or Litton.
  • You made at least three payments on the loan
  • You lived or intended to live in the home as a primary residence when the original loan was signed.
  • The property was no more than a four-unit residential unit.
  • The unpaid principal balance of the first-lien did not exceed $729,750 for a one-unit home, $934,200 for a two-unit property, $1,129,250 for a three-unit dwelling or $1,403,400 for a four-unit property.
  • You make a valid claim.
